OfferUp - Perceived racism and discriminatory intent
Discriminatory and racist intent. I’ve had photos of my own work for sale on OfferUp.
My posts only regard tangible photos for sale. I’ve had listings deleted in the past for saying I’m not offering tangible items. Later review, they’ve acknowledged their mistakes and restored my posts. On occasion people would contact me about my service rates.
OfferUps terms of service do not prohibit me from answering this question. Then I started posting photos for sale that promoted the art of African heritage, African American lifestyle, and African American family. Conveniently enough, after this is when my account gets deleted. I’m told that I’m trying to backdoor moderation because I cannot control who contacts me or about what.
I’ve established my claims that my posts abide by sections 7 and 8 of their terms of service. They tell me it is their opinion that I’m trying to bypass their system. So I enlighten them with the truth. Then the woman handling my case says it’s unlikely that I’ll find a buyer for portraits of other people, that it’s not what the market is looking for.
That I should try and sell landscapes, still life, street art... just not people. I let her know that I was unaware that OfferUp dictated what could sell based on current market trend conditions and failed to find that in the TOS. I also let her know that people consistently sell photos of people; famous and even boxes of vintage.
To recap, when posting photos to sell before, and my posts were flagged and taken down, it was later acknowledged they’ve made a mistake and the posts restored. When I posted photos depicting positive African American images, my account was deleted and was reprimanded. I was told then it was their opinion that my intentions were different, than what they were and they stand by their decision of deleting my account.
My behavior never changed. The only thing that changed was the color of the people I was posting.
Reason of review: Discrimination.
Monetary Loss: $500.
Preferred solution: Stop with the discriminatory practices .
